Terbitnya UU Cipta Kerja yang merubah Undang-Undang Administrasi pemerintahan, dengan hapus kewenangan mengadili Pengadilan Tata Usaha Negara, memberi ketidakpastian hukum bagi pencari keadilan yang sudah melakukan upaya administasi keberatan dan upaya administrasi banding dalam keputusan fiktif positif. Metode yang digunakan normatif, dengan pendekatan perundang-undangan, dan konsep. UU AP menerapkan konsep fiktif positif, dengan ada perubahan UU Cipta Kerja, menunjukan kewenangan PTUN menerapkan konsep fiktif negatif, bukan konsep fiktif positif, sehingga merugikan bagi pencari keadilan.
