Abstract

Elections as a means of political distribution to elect democratic government leaders and people’s representatives require support from citizens, good legal instruments, honest and fair organizers and election participants who comply with election principles and laws. The support of state administrative law with its sanctioning character in organizing elections plays an important role in realizing democratic elections. The problem in this research is formulated as follows: 1) How is the effectiveness of election criminal law enforcement studied? 2) What is the character of administrative sanctions to support the realization of democratic elections? 3) What is the role of the administrative law in supporting the realization of democratic elections? This research is anormative legal research, using statutory and conceptual approaches, with primary and secondary legal materials and qualitative prescriptive analysis. The research results show: 1) Enforcement of electoral criminal law as an instrument to support the realization of democratic elections still needs to be optimized. To support this, the role of the administrative law sector needs to be strengthened. 2) Laws and administrative sanctions have a distinctive character, namely reparation for rights or obligations that are violated/ignored by both election participants and election implementers/organizers. 3) Election administration law functions as a means of supervising the process of holding elections and as a means of protecting rights through administrative sanctions for restoration/repair for administrative violations to support the realization of democratic elections.
